East Chicago, like many industrial areas, has a history of heavy industry, potentially exposing residents to asbestos. Pinpointing the responsible parties in mesothelioma cases is often complex and requires meticulous investigation. Several entities may be liable, including:

Former employers: If your exposure occurred during your employment, your former employer(s) may be held responsible.

east chicago mesothelioma legal question: American Judicial Process Pamela C. Corley, Artemus Ward, Wendy L. Martinek, 2015-09-25 This text is a general introduction to American judicial process. The authors cover the major institutions, actors, and processes that comprise the U.S. legal system, viewed from a political science perspective. Grounding their presentation in empirical social science terms, the authors identify popular myths about the structure and processes of American law and courts and then contrast those myths with what really takes place. Three unique elements of this myth versus reality framework are incorporated into each of the topical chapters: 1) Myth versus Reality boxes that lay out the topics each chapter covers, using the myths about each topic contrasted with the corresponding realities. 2) Pop Culture boxes that provide students with popular examples from film, television, and music that tie-in to chapter topics and engage student interest. 3) How Do We Know? boxes that discuss the methods of social scientific inquiry and debunk common myths about the judiciary and legal system. Unlike other textbooks, American Judicial Process emphasizes how pop culture portrays—and often distorts—the judicial process and how social science research is brought to bear to provide an accurate picture of law and courts. In addition, a rich companion website will include PowerPoint lectures, suggested topics for papers and projects, a test bank of objective questions for use by instructors, and downloadable artwork from the book. Students will have access to annotated web links and videos, flash cards of key terms, and a glossary.

east chicago mesothelioma legal question: Dust-Up Jeb Barnes, 2011-07-08 In an era of polarization, narrow party majorities, and increasing use of supermajority requirements in the Senate, policy entrepreneurs must find ways to reach across the aisle and build bipartisan coalitions in Congress. One such coalition-building strategy is the “politics of efficiency,” or reform that is aimed at eliminating waste from existing policies and programs. After all, reducing inefficiency promises to reduce costs without cutting benefits, which should appeal to members of both political parties, especially given tight budgetary constraints in Washington. Dust-Up explores the most recent congressional efforts to reform asbestos litigation—a case in which the politics of efficiency played a central role and seemed likely to prevail. Yet, these efforts failed to produce a winning coalition, even though reform could have saved billions of dollars and provided quicker compensation to victims of asbestos-related diseases. Why? The answers, as Jeb Barnes deftly illustrates, defy conventional wisdom and force us to rethink the political effects of litigation and the dynamics of institutional change in our fragmented policymaking system. Set squarely at the intersection of law, politics, and public policy, Dust-Up provides the first in-depth analysis of the political obstacles to Congress in replacing a form of litigation that nearly everyone—Supreme Court justices, members of Congress, presidents, and experts—agrees is woefully inefficient and unfair to both victims and businesses. This concise and accessible case study includes a glossary of terms and study questions, making it a perfect fit for courses in law and public policy, congressional politics, and public health.
east chicago mesothelioma legal question: Lead Babies and Poisoned Housing Carolyn R. Boiarsky, 2024-09-01 Drawing on historic sources as well as present-day interviews, Lead Babies and Poisoned Housing is a story about systemic racism, environmental injustice, and the failure of government. In 2016, 1,100 mainly minority residents of a low-income housing complex in East Chicago, Indiana, received a letter from the city forcibly evicting them from their homes because a high level of lead was found in the soil under their houses. The residents were given two months to move. Many could not find safe housing nearby. The site was designated by the Environmental Protection Agency as a Superfund site because of the large amount of toxic material on it. More than 1,300 similar sites are located throughout the United States. Over 70 million people live within three miles of one of these sites. Five years later, the U.S. Department of Housing and Urban Development Office of Inspector General charged three federal agencies—EPA, HUD, and CDC—with causing the lead poisoning of children living in the complex. The EPA, responsible for the cleanup, had been aware of the situation for 35 years. The director of the local housing authority admitted to building the complex over a demolished lead smelter. When health issues arose, the housing authority blamed the residents’ sanitary habits rather than its own failure to maintain the structures. The Center for Disease Control and Preventions’s testing of blood lead levels was revealed to be faulty. In short, the very agencies that were supposed to protect these people instead neglected, ignored, and blamed them. But this isn’t just a story of victimization; it is also about empowerment and community members insisting their voices be heard. Lead Babies and Poisoned Housing records the human side of what happens when the industries responsible for polluting leave, but the residents remain. Those residents tell their stories in their own words—not just what happened to them, but how they acted in response. We should listen, not only for justice, but as a cautionary tale against repeated history.

east chicago mesothelioma legal question: Error Reduction and Prevention in Surgical Pathology Raouf E. Nakhleh, Keith E. Volmar, 2019-07-09 The 1st edition of Error Reduction and Prevention in Surgical Pathology was an opportunity to pull together into one place all the ideas related to errors in surgical pathology and to organize a discipline in error reduction. This 2nd edition is an opportunity to refine this information, to reorganize the book to improve its usability and practicality, and to include topics that were not previously addressed. This book serves as a guide to pathologists to successfully avoid errors and deliver the best diagnosis possible with all relevant information needed to manage patients. The introductory section includes general principles and ideas that are necessary to understand the context of error reduction. In addition to general principles of error reduction and legal and regulatory responsibilities, a chapter on regulatory affairs and payment systems which increasingly may be impacted by error reduction and improvement activities was added. This later chapter is particularly important in view of the implementation of various value-based payment programs, such as the Medicare Merit-Based Incentive Payment System that became law in 2015. The remainder of the book is organized in a similar manor to the 1st edition with chapters devoted to all aspects of the test cycle, including pre-analytic, analytic and post-analytic. The 2nd Edition of Error Reduction and Prevention in Surgical Pathology serves as an essential guide to a successfully managed laboratory and contains all relevant information needed to manage specimens and deliver the best diagnosis.

east chicago mesothelioma legal question: Residues Soraya Boudia, Angela N. H. Creager, Scott Frickel, Emmanuel Henry, Nathalie Jas, Carsten Reinhardt, Jody A. Roberts, 2021-12-31 Residues offers readers a new approach for conceptualizing the environmental impacts of chemicals production, consumption, disposal, and regulation. Environmental protection regimes tend to be highly segmented according to place, media, substance, and effect; academic scholarship often reflects this same segmented approach. Yet, in chemical substances we encounter phenomena that are at once voluminous and miniscule, singular and ubiquitous, regulated yet unruly. Inspired by recent studies of materiality and infrastructures, we introduce “residual materialism” as a framework for attending to the socio-material properties of chemicals and their world-making powers. Tracking residues through time, space, and understanding helps us see how the past has been built into our present chemical environments and future-oriented regulatory systems, why contaminants seem to always evade control, and why the Anthropocene is as inextricably harnessed to the synthesis of carbon into new molecules as it is driven by carbon’s combustion.
